Efektivitas Implementasi PERMA Nomor 3 Tahun 2022 tentang Mediasi Secara Elektronik pada Era Artificial Intelligence: Analisis Perspektif Maqāṣid Asy-Syarī‘ah

The rapid development of Artificial Intelligence (AI) has significantly transformed various sectors, including the legal system and judicial dispute resolution mechanisms. One of the legal innovations in Indonesia is the issuance of Supreme Court Regulation (PERMA) Number 3 of 2022 concerning Electronic Mediation in Courts. This regulation was established as a response to technological advancements and the necessity of efficient, accessible, and modern dispute resolution processes. This article aims to analyze the effectiveness of PERMA Number 3 of 2022 amid the massive expansion of Artificial Intelligence from the perspective of Maqāṣid asy-syarī‘ah. The research employs a normative legal research method using statutory, conceptual, and analytical approaches. The findings indicate that electronic mediation has contributed positively to judicial efficiency, cost reduction, and broader access to justice. Nevertheless, the implementation still faces several obstacles, such as digital inequality, technological literacy limitations, cybersecurity concerns, and ethical challenges in the use of AI within mediation processes. From the perspective of maqāṣid asy-syarī‘ah, electronic mediation aligns with the objectives of Islamic law, particularly in preserving wealth (hifz al-mal), protecting human dignity (hifz al-'ird), safeguarding intellect (hifz al-'aql), and realizing public benefit (maslahah). However, the utilization of AI in mediation must remain under human supervision to maintain justice, transparency, and ethical values. Therefore, the effectiveness of PERMA Number 3 of 2022 depends not only on technological readiness but also on the integration of legal, ethical, and sharia-based principles in its implementation.
